By accessing or using Diboll Fitness’s website (www.dibollfitness.com), enrolling in a membership, or using any related mobile apps, blog, or online services (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our Services.

1. Membership

  • Memberships are subject to approval by Diboll Fitness.
  • Members must be at least 16 years old.  Children under 16 may not register or provide personal information; any such data will be deleted.  Children under 16 are not permitted to be inside the gym.
  • All memberships must be completed through our secure online system. Members receive a personalized door code or access via a mobile app. Access credentials must not be shared.
  • Membership fees, plans, and benefits are subject to change and may vary.

2. Rules and Regulations

  • Members must comply with all posted gym rules, policies, and guidelines, including safety instructions, proper attire, and the use of equipment.
  • Diboll Fitness reserves the right to refuse access or terminate memberships for any violation of these terms, gym rules, or applicable laws.

3. Assumption of Risk & Liability Waiver

By using Diboll Fitness facilities or Services, you acknowledge and voluntarily accept the inherent risks associated with exercise, including injury, illness, or property damage. You agree to use the Services at your own risk and release Diboll Fitness, its staff, affiliates, and providers from all claims, to the fullest extent permitted by law.

4. Facility Monitoring & Surveillance

Public areas of Diboll Fitness facilities are monitored by 24/7 video surveillance for safety and incident resolution. Surveillance does not include private areas such as restrooms and showers. While cameras are present, real-time monitoring is not guaranteed.

5. Payment and Fees

  • Members agree to pay all applicable fees and taxes for their membership plan.
  • Payments must be current. Late, declined, or returned payments may result in additional fees or suspension of access until the issue is resolved.

6. Cancellation and Refund Policy

  • Three-Day Right to Cancel: New members may cancel within three (3) business days of signing up for a full refund.
  • Standard Cancellation: After 3 days, members may cancel at any time with 30 days’ written notice.
  • Relocation: Members may cancel if moving more than 25 miles from Diboll Fitness.
  • Medical Disability: Members may cancel with a doctor’s note if they are unable to use the facility for more than three months.
  • Death or Permanent Disability: Membership may be canceled by the member’s estate.
  • Closure or Relocation: If Diboll Fitness closes or relocates more than 10 miles away without a replacement facility, members may cancel.
  • Freeze Policy: Members may freeze their membership for up to 3 months by submitting a request at least 7 days in advance.


Cancellation requests must be made through the member portal, by email to info@dibollfitness.com, by certified mail to PO Box 155804, Lufkin, TX 75915-5804, or by phone at 936-233-6587. Refunds, when applicable, will be processed within 30 days.

7. Personal Information and Privacy

Your use of the Services is subject to our Privacy Policy. Personal information is protected and used by this policy. Diboll Fitness may use your information for account management and marketing, in compliance with applicable laws.

8. Intellectual Property

All content on the Site and Services, including text, graphics, logos, software, and designs, is owned by Diboll Fitness or licensed to us. Users may view content for personal, non-commercial use only. Copying, distributing, or modifying content without written consent is prohibited. “Diboll Fitness” and the Diboll Fitness logo are registered trademarks and may not be used without permission.

9. User Conduct

  • You agree not to violate any laws or third-party rights.
  • Do not upload malicious software or disrupt the Site or Services.
  • Do not use unauthorized access credentials.
  • Do not transmit spam or unauthorized communications.


Unauthorized use may result in termination and legal action.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. Diboll Fitness does not guarantee uninterrupted operation or fitness for a particular purpose.

11. Limitation of Liability

Diboll Fitness and its affiliates are not liable for indirect, incidental, or consequential damages from your use of the Services. You agree to use the Services at your own risk.

12. Indemnification

You agree to indemnify and hold harmless Diboll Fitness, its staff, and providers from any claims arising from your use of the Services or breach of these Terms.

13. External Links

The Site may contain links to third-party websites. Diboll Fitness is not responsible for the content or practices of its affiliates. Use at your discretion.

14. Changes to Terms and Privacy Policy

Diboll Fitness reserves the right to update these Terms and the Privacy Policy at any time. Updates will be posted with a revised date. Continued use of the Services indicates acceptance.

15. Governing Law

The laws of the State of Texas govern these Terms and Conditions. Disputes shall be resolved exclusively in courts located in Angelina County, Texas.
