Terms and Conditions

Effective Date: July 16, 2025

1. Membership Eligibility and Age Requirements

Members must be at least 16 years of age.
Members aged 16–17 may join only with parental or guardian consent and must be accompanied by that parent or guardian at all times while in the gym.
Members aged 18 and older may work out independently without supervision.
Children under 16 are not permitted to enter or remain in the facility for any reason.

2. Membership Payments and Terms

Memberships are available on a month-to-month basis at $39.99/month for Gym OR Classes only or at $59.99/month for both gym and classes.
All memberships must be signed and paid for through our online portal.
Memberships auto-renew unless canceled in accordance with the cancellation policy below.
A 2-day free trial is available to first-time visitors.
Refunds are only available within the first 3 business days of initial signup.

3. Cancellation Policy

Our cancellation policy complies with the Texas Health Spa Act. You may cancel your membership under the following conditions:

3-Day Right to Cancel: Cancel without penalty within 3 business days of joining.
30-Day Standard Cancellation: Cancel anytime with 30 days’ notice.
Relocation: Cancel with proof of relocation more than 25 miles from the facility.
Medical Disability: Cancel with documentation of a condition lasting longer than 3 months.
Death or Permanent Disability: Immediate cancellation with required documentation.
Facility Closure or Relocation: Cancel if Diboll Fitness permanently closes or relocates more than 10 miles from the original location.

4. Facility Access and Use

Access is granted via a personalized door code and/or mobile app.
Facility use is available 24/7 to active members.
Members aged 16–17 must be accompanied by their parent or legal guardian during each visit.
Sharing access codes or allowing non-members to enter the facility is strictly prohibited and grounds for immediate membership termination.

5. Towel and Locker Service

Locker rooms and showers are available. Members may bring their own towels. Diboll Fitness is not responsible for lost or stolen items.

6. Conduct and Behavior

Members must treat others respectfully and use equipment responsibly.
Harassment, verbal abuse, or unsafe conduct will result in disciplinary action or termination.
Diboll Fitness reserves the right to revoke access at any time for violations of these terms or any posted policies.

7. Surveillance and Security

Video surveillance is used throughout the facility for safety and monitoring purposes. By entering the gym, members consent to this monitoring. Surveillance is reviewed to ensure compliance with age and conduct rules.

8. Waiver of Liability

Members voluntarily assume all risks related to use of gym equipment and participation in physical activities. Diboll Fitness is not liable for injuries or accidents occurring on the premises. Members agree to release and hold harmless Diboll Fitness, its owners, staff, and affiliates from all liability, to the fullest extent allowed by law.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas. If any provision is found invalid, the remaining provisions will remain in full force and effect.
